- Under the Solicitors Remuneration Order 2023, the scale is 1.25% of the first RM500,000 (minimum RM500) and 1% of the next part up to RM7.5 million. A RM600,000 purchase comes to RM7,830 with 8% service tax, and the loan agreement is charged separately on the same scale.
- Can lawyers give a discount on the scale fee?
- Yes, up to 25% of the scale fee under SRO 2023. Above RM7.5 million the fee is negotiable and capped at 1%.
- Is there service tax on legal fees?
- Yes. Professional services carry 8% service tax, charged on the fee. Disbursements such as searches and registration are billed on top.
- Do I pay legal fees twice if I take a loan?
- Usually yes. One fee covers the transfer and another covers the loan agreement. The same scale applies, and the loan fee is worked out on the loan amount.
- Are legal fees different at a bank auction?
- There is no sale and purchase agreement to draft at a bank auction, but you still need a lawyer for the transfer, and the loan documents if you borrow. Ask for the quote in writing before you bid.
