Frequently asked questions
- How is stamp duty on a house calculated in Malaysia?
- Malaysian citizens and permanent residents pay 1% on the first RM100,000, 2% on the next RM400,000, 3% on the next RM500,000 and 4% above RM1 million, on the higher of the price and the market value. A RM600,000 house comes to RM12,000.
- How much is stamp duty on the loan agreement?
- The loan agreement is stamped at 0.5% of the loan amount. A RM540,000 loan costs RM2,700.
- Is there a stamp duty exemption for first-time home buyers?
- Yes. A Malaysian citizen buying a first residential property with a market value up to RM500,000 is fully exempt on both the transfer and the loan agreement, for sale and purchase agreements executed by 31 December 2027 (P.U.(A) 53/2021 and 54/2021, as amended in December 2025). Budget 2027 proposes full exemption on the first RM500,000 and 50% on the rest up to RM750,000 for agreements from 2027 to 2030; this calculator does not apply that proposal until it is gazetted.
- What stamp duty do foreigners pay on property in Malaysia?
- Foreign buyers and foreign companies pay a flat 4% on the transfer, and 8% on residential property from 1 January 2026, instead of the 1% to 4% scale.
- Does stamp duty apply when I buy at a bank auction?
- Yes. The transfer is stamped on the higher of your winning bid and the market value, so a low bid does not always lower the duty. The first-home orders are worded around a sale and purchase agreement while an auction is sold by memorandum of sale or certificate of sale, so ask your lawyer whether your lot qualifies.
- Who pays the stamp duty, the buyer or the seller?
- The buyer pays stamp duty on both the transfer and the loan agreement, usually through the lawyer handling the purchase.
